Terms of Use
The short version: Drowsly is an assistive aid for tired, late-night phone use — not a safety guarantee and not a medical device. Drowsly needs either an auto-renewing annual subscription (new subscribers start with a 3-day free trial) or, while it is offered, Founder Lifetime, a one-time purchase that does not renew, both billed through Apple or Google Play. Use it as an aid — never rely on it to keep you safe — and these terms will rarely matter to you.
1. These terms
These terms govern your use of the Drowsly app for iPhone and Android and this website (together, "Drowsly"). They are an agreement between you and Helfi Systems AB (org.nr 559593-9520), a company registered in Sweden, referred to below as "we" — full contact details are at the foot of this page. By downloading or using the app, or by using this site, you agree to them. If you get the app through Apple's App Store or Google Play, that store's standard licence terms apply alongside these; where they conflict for store matters (billing, refunds), the store's terms control.
2. What Drowsly is — and what it is not
Drowsly uses your phone's motion sensors to notice signs you may be drifting off while holding the phone, and can give you a gentle nudge to rest, followed by stronger steps if you don't respond.
Drowsly is an assistive tool that may help alert you. It cannot detect every situation and does not guarantee you will wake or be protected. It is not a medical device, and it does not diagnose, treat, or monitor any medical condition. You remain responsible for your own safety — never rely on Drowsly to keep you safe. If you have a sleep disorder or any health concern, talk to a healthcare professional; Drowsly is not a substitute for one — or for sleep itself.
3. Your subscription
- Access requires either an auto-renewing annual subscription or, while it is offered, Founder Lifetime, a one-time purchase that does not renew. Both unlock every feature. Eligible new subscribers get a 3-day free trial with full access; Apple or Google Play decides eligibility. Unless you cancel at least 24 hours before the trial ends, the annual price is charged when the trial ends, and the subscription then renews yearly. The exact price of each available option is always shown in the App Store or Google Play before you confirm.
- Billing, renewal, and cancellation are handled entirely by Apple or Google, depending on where you got the app. You can cancel anytime in your Apple ID or Google Play subscription settings; cancelling at least 24 hours before the trial or current period ends means you won't be charged for the next one.
- Refunds for store purchases are requested from Apple or Google, depending on where you bought it. Nothing in these terms limits your statutory rights as a consumer, including your withdrawal rights under EU law.
4. Using Drowsly responsibly
Drowsly is licensed to you for personal, non-commercial use. Don't misuse it: don't try to circumvent the subscription, redistribute the app, or reverse-engineer it except to the extent applicable law expressly permits.
5. Intellectual property
The Drowsly app, name, mark, design, and the content of this site belong to us. Using Drowsly gives you a personal licence to use the app; it transfers no ownership.
6. Warranties and liability
We build Drowsly with care, but — like any software — we cannot promise it will be uninterrupted or error-free, and (as section 2 makes explicit) we cannot promise it will detect every drowsy moment.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law — including liability arising from our gross negligence or intent, and including your mandatory rights under Swedish and EU consumer law, which apply in full. Subject to that, we are not liable for damage caused by using Drowsly contrary to these terms or to its stated purpose as an assistive aid.
7. Changes
We may evolve the app and these terms. If we change the terms in a way that meaningfully affects you, we will update the effective date above and, for material changes, tell you in the app before they apply. The version published here is always the current one.
8. Governing law and disputes
These terms are governed by Swedish law. Disputes can be brought before the Swedish courts; if you are a consumer, you may also be entitled to sue and be sued in your country of residence. As a consumer you can also turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, arn.se).
